Louisiana Real Estate Commission State Mandated Purchase Agreement 2009

This is the official Purchase Agreement used across Louisiana. For Sale By Owner's can also use this agreement. It favors neither Buyer nor Seller, so it is a fair contract for both parties to use when buying and selling real estate.

Exclusive Right To Represent Agreement

This is the agreement that real estate agents use to enter into a contract with a Buyer. It basically establishes that both the Buyer and the real estate agent are agreeing that the agent will represent the buyer in finding a property. The agent will represent the buyer alone, and work to get the buyer the best deal possible. On the other hand, the Buyer will limit their dealings only with this agent so that:

1. The Buyer will not compromise their position as a Buyer and give confidential information to the Seller's Party.

2. The agent can work tirelessly to find the Buyer the right property, with the commitment of the Buyer to monetarily reimburse the agent for their efforts.

This essentially makes a Buyer a client of the Real Estate Agent and the real estate agent an employee of the Buyer.

Listing And Marketing Agreement

This is the agreement that real estate agents use to enter into a contract with a Seller. It basically establishes that both the Seller and the real estate agent are agreeing that the agent will represent the Seller in both the listing and marketing of their property. The agent will represent the Seller alone, but may be allowed to work for the Buyer of the property as well (a.k.a. Dual Agency) and work to get the Seller the best deal possible. On the other hand, the Seller will limit their dealings only with this agent so that:

1. The Seller will not compromise their position as a Seller and give confidential information to the Buyer's Party.

2. The agent can work tirelessly to find the Seller A Buyer for their property, with the commitment of the Seller to monetarily reimburse the agent for their efforts.

This essentially makes a Seller a client of the Real Estate Agent and the real estate agent an employee of the Seller.
